Terms of Service
Last updated: October 27, 2026.
These Terms of Service (“Terms”) are the agreement between you and us covering durendo.com and the Durendo application. Durendo is operated by Hagegard LLC, a California limited liability company doing business as Durendo (“Durendo,” “we,” “us,” “our”). By creating an account or using Durendo, you accept them.
How to read these Terms. Each section begins with a brief summary to help you navigate the document. The full terms below each summary govern your use of Durendo.
1. What Durendo is, and what it is not
In plain words Durendo helps you understand your finances and compare planning choices. Its projections and comparisons are estimates based on your information and the assumptions and rules used in the software. Durendo is educational software, not a financial adviser, and does not manage your money. If you feel you need advice, consider seeking it from a licensed professional.
Durendo is retirement planning software for educational use, built around United States retirement, tax and account rules. It provides projections, market simulations, tax calculations and comparisons of planning choices using your information, assumptions you enter or accept, and the rules and models built into the software.
Durendo does not provide financial, investment, tax, legal, accounting, or estate-planning advice. It does not recommend that you buy, sell, or hold any security or product; it does not manage, hold, or move money; it has no discretion over any account; and it does not act as your adviser, broker, planner, or fiduciary. Using Durendo does not create an advisory or fiduciary relationship.
Every projection, tax figure, and estate figure Durendo produces is an estimate generated from your inputs and from the laws and assumptions modeled in the software as of the dates stated in the app. It is not a prediction, a guarantee, or personalized advice. Our Not Financial Advice disclosure states this boundary in full and is part of these Terms.
Investment features. If Durendo shows your holdings, model portfolios published by others, or the result of an allocation tool you run, these are outputs of a model using your inputs and the assumptions shown. They are not a recommendation to buy, sell or hold any security, and Durendo does not choose a portfolio for you; you decide. Prices and fund information may come from third parties or from institutions you link. They can be delayed or wrong and are provided for planning, not trading.
AI features. If you use a Durendo feature that answers questions with artificial intelligence, its answers are generated automatically and can be incomplete or wrong. They are educational, like the rest of Durendo, and are not advice. Check anything important against your plan’s own figures or with a professional. Our Privacy Policy explains what such a feature sends to an AI service provider and how long it is kept.
2. Who may use Durendo
In plain words You must be 18 or older. Access is currently by invitation. Durendo models United States retirement, tax and account rules. If you use it from another country, consider whether those rules fit your situation. Your plan data is stored in the United States.
You must be at least 18 years old and able to enter into a binding contract. Durendo is not intended for use by anyone under 18.
Access is currently by invitation. Durendo is designed around United States retirement, tax and account rules. It is not designed to model another country’s retirement or tax system.
If you use Durendo from outside the United States, you are responsible for deciding whether it is appropriate for your situation and for complying with laws applicable to your use. Durendo is operated from the United States, and your plan data is stored there. Our Privacy Policy explains how Durendo and its service providers handle your information.
3. Your account
In plain words Keep your sign-in details private and your account information current. You are responsible for activity you conduct or authorize through your account. If you suspect unauthorized access, contact us promptly.
Keep your account information accurate and up to date, and protect your sign-in details from unauthorized use. You are responsible for activity you conduct or authorize through your account.
Sign-in is handled by our sign-in provider. Durendo does not receive or store your password. We recommend using two-step sign-in or passkeys to help protect your account.
If you suspect unauthorized access, notify us promptly at hello@durendo.com.
4. Early access
In plain words Durendo is currently free and available by invitation. We are continuing to develop it, so features may change and errors or interruptions may occur. If your invitation includes a period of extra features, your account simply returns to the free plan afterwards. We will email you about Durendo itself; every such email has an unsubscribe link. Keep your original financial records. If we plan a change that requires removing your stored plan data, we will give you at least 14 days’ notice and an opportunity to export it.
During this invitation-only beta:
- Access is free. We are not selling paid memberships during beta, and no automatic renewal is running. Section 5 explains how paid access could be introduced.
- Invitations may include extra features for a period. An early-access invitation may include a period of access to features we later offer as a paid plan. When that period ends, your account continues on the free plan, your saved plans remain, and nothing is charged unless you choose to subscribe under section 5.
- Emails about Durendo. By accepting these Terms you agree that we may email you about Durendo itself: new features, changes to the service and tips for getting started. Every such email includes an unsubscribe link, and you can unsubscribe at any time. Unsubscribing does not stop emails about your account, security or billing, which we send to operate the service.
- The service is evolving. Features may be added, changed, limited or withdrawn without notice. Errors or service interruptions may occur.
- Planned data removals require notice. If we plan a change that requires removing your stored plan data, we will email you at least 14 days beforehand. Export will remain available throughout that notice period. This notice commitment concerns planned removals, not accidental data loss or service interruptions. Keep your original financial records; an export is a copy of your data, not a restore file.
- Usage sharing is optional. You can turn off Share how I use Durendo in Settings > Privacy. This stops new optional usage records but does not erase existing records. Necessary account and service records continue. Our Privacy Policy explains what is collected, how long it is kept, and your controls.
- Feedback helps us improve. If you send feedback or suggestions, you give us a non-exclusive, worldwide, royalty-free, perpetual license to use them to improve Durendo, without payment or credit and without any obligation to act on them. This does not give us any rights in your plan data. Personal information included in feedback remains subject to our Privacy Policy. Include only information and screenshots you are comfortable sharing with us.
5. Fees and paid access
In plain words Early access is free. We will not automatically turn your access into a paid subscription. If we introduce paid plans, you will see the price and terms before deciding whether to subscribe. A subscription renews until you cancel, and you can cancel online at any time.
Durendo does not currently charge for invitation-only early access.
If we introduce paid plans, we will explain what is included, the price, applicable taxes, billing frequency, any automatic renewal, and the cancellation and refund terms before you subscribe. We will obtain your agreement to the applicable payment and renewal terms before charging you.
If you subscribe. A paid plan renews automatically at the end of each billing period at the price then in effect, until you cancel. You can cancel online at any time in Settings; cancelling stops the next renewal, and you keep paid features until the end of the period you have paid for. We will tell you about a price change at least 30 days before it applies to your next renewal, so you can cancel before then. If a payment fails, we may retry it; if it still fails, your account moves to the free plan and your saved plans remain. Applicable taxes are shown before you pay. Our payment processor handles your card details.
Participation in free early access does not automatically enroll you in a paid plan or authorize future charges.
6. Refunds
In plain words Early access is free, so there are currently no subscription payments to refund. If we introduce paid plans, we will explain the refund policy before you subscribe.
Durendo does not currently charge for invitation-only early access. Before offering paid plans, we will publish the applicable refund terms and make them available before purchase.
If you believe you have been charged for Durendo in error, contact hello@durendo.com.
7. Acceptable use
In plain words Use Durendo for your own and your family’s planning. Do not access other users’ accounts or data without authorization, resell access, copy the software to build a competing product, attack or disrupt the service, get around its protections, or use a false identity. Automated access requires our permission. You may use your own exported plan data outside Durendo.
You agree not to:
- access or attempt to access another user’s account or data without authorization;
- reverse engineer, decompile, or copy the service in order to build a competing product;
- use Durendo for any unlawful purpose, or in violation of these Terms;
- resell, sublicense, or provide Durendo to third parties as a service, except that you may use Durendo to prepare plans for yourself, your household, or family members you help without charge;
- upload or transmit malicious code, or use the service to attack another system;
- try to get around security, rate limits or access controls;
- create an account with false identity details or impersonate someone else; or
- interfere with the service, including by sending request volumes designed or likely to degrade it for other users.
Automated access. Do not use automated tools, including bots, scrapers or AI agents, to access, query or extract data from Durendo unless we expressly authorize that use. This includes automated probing, benchmarking, load testing and collection of training data. Any authorized API must be used within its documented limits.
This restriction does not prohibit ordinary browser functions, password managers or assistive technologies used to operate your own account. It does not restrict your use of your own exported plan data outside Durendo.
We may limit or block traffic we reasonably believe violates these rules, and may suspend or terminate accounts engaged in prohibited activity as described in section 15.
8. Your data
In plain words Your plan data is yours. We use it to operate Durendo for you. We do not sell it. We do not use your financial data to train AI models, and we only use AI services under terms that prohibit them from doing so. You can export your data or delete your account.
Your plan data remains yours. You grant us only the limited permission needed to host, process, back up and display that data to operate Durendo for you. This permission does not give staff access to your financial plan.
If you send information or screenshots to support, staff can read what you choose to share. Our Privacy Policy governs how we handle your information, including support messages.
Information about other people. You may enter information about other members of your household, such as a spouse, partner or dependents, as part of your planning. You are responsible for having the right to do so, and we handle it under our Privacy Policy. If you share a plan with someone, they can see what the share allows until you remove it; you decide who you share with.
Linked accounts. If you choose to link a financial account, you connect through our account-connection partner and sign in with your institution; Durendo never receives your institution password. Linking gives Durendo read-only access to the information you approve, such as balances and holdings, to keep your plan current. Durendo cannot move money, place trades or change anything at your institution. You can unlink an account at any time. The partner’s own privacy policy also applies to what it collects.
We do not sell your plan data. We do not use your financial data to train AI models, and we only use AI services under terms that prohibit them from doing so.
You can export your data or delete your account from the app. Export provides a machine-readable copy of your data; it is not a full backup or a restore mechanism. Deletion and backup retention follow the Privacy Policy.
9. Our intellectual property
In plain words Durendo’s software, original design and content belong to us or our licensors. You may use Durendo for your own and your family’s planning under these Terms. Your plan data remains yours.
Intellectual-property rights in Durendo’s software, original design and content belong to us or our licensors. Subject to these Terms, we grant you a personal, non-exclusive, non-transferable license to use Durendo for planning for yourself, your household, or family members you help without charge. That license may be revoked as provided in section 15.
This license does not transfer ownership of Durendo’s intellectual property or affect your rights in your plan data. All rights not expressly granted are reserved.
“Durendo” and our logos are our trademarks. You may not use them without our permission, except as permitted by law.
10. No warranty
In plain words Durendo is provided “as is.” We cannot promise uninterrupted service, error-free calculations or particular financial outcomes. This does not remove our express commitments in these Terms or our Privacy Policy, or protections that applicable law does not allow us to exclude.
EXCEPT FOR COMMITMENTS EXPRESSLY MADE IN THESE TERMS OR OUR PRIVACY POLICY, AND TO THE MAXIMUM EXTENT PERMITTED BY LAW, DURENDO IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTY OF ANY KIND, EXPRESS, IMPLIED, OR STATUTORY, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
We cannot guarantee that Durendo will be uninterrupted, error-free or immune to security incidents, or that its calculations, tax treatments and simulations will be free of defects.
Projections and simulations are estimates based on your information, assumptions you enter or accept, and the rules and models built into Durendo. Actual outcomes may differ materially. These results do not guarantee any financial outcome. See our Not Financial Advice disclosure.
Some jurisdictions do not allow the exclusion of certain warranties; to the extent a disclaimer above is not permitted where you live, it does not apply to you.
11. Limitation of liability
In plain words Subject to the exceptions below, our total liability is limited to the greater of $100 and what you paid us for Durendo in the 12 months before the event giving rise to your claim. We also exclude certain types of losses, including lost investment returns and lost tax savings. These limitations do not cover fraud, gross negligence or the other exceptions below, and do not remove rights or remedies that applicable law does not allow you to waive.
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
(a) Cap. Subject to the exceptions in paragraph (c), our total liability to you for all claims arising out of or relating to Durendo or these Terms will not exceed the greater of $100 and the amounts you paid us for Durendo in the 12 months before the event giving rise to the claim.
(b) Excluded damages. We are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost investment returns, lost tax savings, lost data, or loss of goodwill, including damages arising from any decision you make based on Durendo’s output, even if we were told such damages were possible.
(c) What this section does not cover. This section does not limit liability that cannot be limited under applicable law. In particular, and without limiting that sentence, it does not apply to liability for fraud, fraudulent misrepresentation, willful injury to the person or property of another, violation of law, or gross negligence, and nothing in these Terms waives or limits any right or remedy you have under the California Consumers Legal Remedies Act or any other statute whose protections cannot be waived by contract.
(d) Basis of the bargain. These limitations are part of the terms on which Durendo is provided. Sections 10 and 11 survive termination of these Terms.
12. Indemnification
In plain words If a third party brings a claim against us because you breached these Terms, you must defend us and cover the resulting damages and reasonable legal costs. We will notify you promptly, let you control the defense, and cooperate reasonably. This does not apply to claims caused by our own conduct.
You will defend, indemnify, and hold harmless Durendo and its members, officers, and contractors from third-party claims, damages, and reasonable attorneys’ fees arising out of your use of Durendo in violation of section 7 (Acceptable use) or your breach of these Terms. We will notify you promptly of any such claim, give you control of the defense (except that we may participate with our own counsel at our expense), and cooperate reasonably. You may not settle a claim in a way that imposes any obligation or admission on us without our consent. This section does not apply to a claim caused by our own conduct.
13. Dispute resolution: arbitration and class-action waiver
In plain words Contact us first so we can try to resolve the dispute. Unless you opt out, most unresolved disputes will be decided individually by an arbitrator rather than a judge or jury. Fees follow the AAA’s consumer rules and applicable law. Small claims and certain requests for court orders remain available. You can opt out of arbitration and this section’s class-action waiver by emailing us within 30 days of accepting this agreement. Your opt-out is permanent.
Talk to us first. Before starting arbitration, you must email hello@durendo.com with a description of the dispute and the relief you want. If we have a dispute with you, we will send the same information to the email address associated with your account. Both parties will allow 30 days after receipt of the notice to try to resolve the dispute. To the extent permitted by applicable law, filing deadlines for the dispute are suspended during this period. Either party may make a filing needed to preserve a claim before a deadline expires or seek urgent court relief otherwise permitted by this section without waiting for the period to end.
Arbitration. Unless you opt out or an exception below applies, any dispute arising out of or relating to these Terms, the Privacy Policy, or Durendo will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court. The arbitration will be held in the county where you live or, if you prefer, by telephone, videoconference, or on documents only. The arbitrator may award any relief a court could award to you individually. Judgment on the award may be entered in any court with jurisdiction. If the AAA declines to administer the dispute, either party may bring it in court, subject to section 14 and applicable law.
Fees. Fees will be allocated under the AAA Consumer Arbitration Rules and applicable law. Durendo will pay the fees and arbitrator compensation those rules or applicable law require it to pay. Any fee waiver or reallocation will be subject to those rules and applicable law.
Carve-outs. Either party may bring an individual claim in small claims court. Either party may seek injunctive relief in court to protect its intellectual property. Nothing in this section waives either party’s right to seek public injunctive relief in a court of competent jurisdiction. Any claim for public injunctive relief is severed from arbitration; the court will decide whether a stay is appropriate under applicable law. Nothing here prevents you from reporting a matter to a government agency.
Individual proceedings and jury trial. For disputes subject to arbitration, an arbitrator rather than a judge or jury will decide the dispute. Unless you opt out, you and Durendo each waive the right to bring or participate in a class, collective, consolidated, or representative action, other than a claim for public injunctive relief as carved out above. If the class-action waiver is found unenforceable as to a particular claim, that claim is severed and heard in court; the rest of this section still applies. This section does not waive any right to a jury trial for claims that proceed in court.
Your 30-day opt-out. You may opt out of this arbitration agreement and this section’s class-action waiver by emailing hello@durendo.com and saying you want to opt out, within 30 days of first accepting this arbitration agreement. Include the email address associated with your account so we can record your choice. If we materially change this arbitration agreement, you may opt out within 30 days after the later of the date we present the change to you or its effective date. If you opt out, neither you nor Durendo is bound by this section’s arbitration requirement or class-action waiver. Opting out costs you nothing and changes nothing else about your account. Once you opt out, the opt-out stands for all future versions of this section; you never have to opt out again because we updated the wording.
Survival. This section survives termination of these Terms, subject to any opt-out you have made.
14. Governing law and venue
In plain words California law governs these Terms. Court proceedings generally take place in Los Angeles County, with exceptions for small claims and where applicable law requires another location. This does not take away mandatory consumer protections that apply to you.
These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. This choice of law does not deprive you of mandatory consumer protections that apply to you under applicable law.
Except for individual small-claims proceedings permitted under section 13, or where applicable law requires otherwise, disputes that proceed in court must be brought in the state or federal courts located in Los Angeles County, California. Both parties consent to personal jurisdiction in those courts. Small-claims proceedings may be brought in any court with jurisdiction and proper venue.
This section does not change the arbitration location options in section 13.
California residents. If you are a California resident, you may contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs in writing at 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834, or by telephone at (800) 952-5210, to resolve a complaint about Durendo.
15. Termination, and what happens if Durendo shuts down
In plain words You can delete your account whenever you like. We may suspend or end access if you breach these Terms, or where needed to protect the service or comply with law. If we plan to shut Durendo down, we will normally give you at least 60 days’ notice and an opportunity to export your data.
By you. You may delete your account from Settings at any time. Export any data you want to keep before deleting it.
By us. We may suspend or terminate your account if you breach these Terms, or where needed to protect the service or its users or comply with law. We will give notice to your account email unless doing so would create a security risk or be legally prohibited.
If Durendo shuts down. If we plan to discontinue Durendo, we will give you at least 60 days’ notice by email and keep plan-data export available during that notice period. If legal requirements or circumstances beyond our reasonable control require an earlier shutdown, we will give as much notice and opportunity to export as reasonably possible. Your data will be handled under the retention and deletion provisions of our Privacy Policy.
On termination, your license under section 9 ends and sections 8, 10, 11, 12, 13, 14, and 18 survive.
16. Changes to these Terms
In plain words We may update these Terms. When we make a material change, you will be asked to accept the revised Terms the next time you sign in, before continuing to use Durendo. If you do not accept, you may stop using the service and contact us to arrange export or deletion of your data. Minor changes that do not materially affect your rights or obligations do not require separate acceptance.
We may update these Terms from time to time. For material changes, we will present the revised Terms in the app the next time you sign in and require affirmative acceptance before continued use under the revised Terms. The revised Terms take effect on the “Last updated” date shown on them.
If you do not accept, you may stop using Durendo. Contact hello@durendo.com if you need help exporting your data or deleting your account without accepting the revised Terms.
Minor changes, such as correcting typographical errors, take effect when posted with an updated “Last updated” date, provided they do not materially affect your rights or obligations.
If a change materially affects section 13, we will identify it specifically when we present the revised Terms. The opt-out rights in that section apply, and any previous opt-out remains effective.
17. Copyright complaints
In plain words Think something on Durendo infringes your copyright? Email us with the details.
To report content you believe infringes your copyright, email hello@durendo.com. Identify the copyrighted work and the material you believe infringes it, including a link or other information that helps us locate it. Include your contact details and a statement that you believe in good faith that the use is not authorized by the copyright owner, its agent or the law.
We review copyright complaints and take appropriate action, which may include removing or disabling access to material. We terminate the accounts of repeat infringers in appropriate circumstances.
18. General
In plain words If one provision cannot be enforced, the rest generally remains effective. If the business is transferred, the successor must take on our obligations. You need our written permission to transfer your account. Keep your email address current so we can contact you. These Terms, our Privacy Policy and our Disclaimer form the agreement governing your use of Durendo.
Severability. If any provision of these Terms is held unenforceable, it is modified to the minimum extent necessary or severed, and the rest remains in effect. Section 13 contains its own severability rules, which control within that section.
No waiver. Our failure to enforce a provision is not a waiver of it.
Assignment. You may not assign these Terms or your account without our written consent. We may assign these Terms to a successor in connection with a merger, acquisition, or sale of assets, on notice to you. The successor must assume our obligations under these Terms, including our privacy commitments.
Notices. We give notice by email to the address on your account, or by a prominent notice in the app. Where these Terms specifically require email notice, an in-app notice does not replace it. You give notice to hello@durendo.com. Keep your email address current.
Events outside our control. Neither party is responsible for a delay or failure to perform to the extent caused by circumstances beyond its reasonable control. The affected party must take reasonable steps to limit the effects and resume performance. This provision does not excuse a failure to take reasonable precautions and remains subject to the exceptions in section 11(c).
Electronic notices. You agree that we may give you notices and legally required disclosures electronically, by email or in the app. You can ask for a paper copy of any notice by writing to our mailing address in section 19.
Accessible formats. If you need these documents in another format, or have trouble using them because of a disability, email hello@durendo.com and we will help.
No partnership. Nothing in these Terms makes you and us partners, agents or employees of each other.
Entire agreement. These Terms, together with the Privacy Policy and the Not Financial Advice disclosure, are the entire agreement between you and us about Durendo, and replace any earlier understanding.
19. Contact
Hagegard LLC d/b/a Durendo, 914 Valley Crest Street, La Cañada Flintridge, CA 91011. hello@durendo.com.
